Terms and Conditions

1. Definitions

 

In these terms and conditions: ‘the Property’ means BarbaLucia, West Road, Lodge Hill, St. Michael, Barbados, West Indies; ‘the Landlord’ means Mrs. C. Dalphinis-King of 23 Bexley Road, Fishponds, Bristol, Avon BS16 3SS, England; ‘the Guest’ means a person who submits a BarbaLucia Holiday Reservation Booking Form and who has been permitted by the Landlord to occupy the Property for a specified Term; ‘the Term’ shall mean the agreed arrival and departure dates and times between which Guests will be permitted to occupy the Property.

 

 

 

 

 

 

 

 

2. Rental Deposit

 

 

 

 

 

 

 

Payment of a sum equal to twenty-five per cent (25%) of the total rental cost of the Property for the Term (‘Rental Deposit’) will be required before a reservation booking can be confirmed.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

3. Security Deposit

 

 

 

 

 

 

 

In addition to the Rental Deposit, a deposit of eighty Pounds Sterling (£80.00), shall be required as security against replacement of any damaged goods in the property, damage to the property or failure to return the key upon vacating the premises (‘Security Deposit’).

 

 

 

 

 

 

 

 

 

 

 

 

 

 

The Security Deposit shall be refunded upon vacation of the property, PROVIDED ALWAYS THAT:

 

 

 

 

 

 

 

 

 

 

 

 

 

 

(a) there has been no damage caused to the Property or any goods therein; and

 

 

 

 

 

 

 

(b) the keys to the Property have been returned to the Landlord.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

4. Keys Collection and Payment

 

 

 

 

 

 

 

(a) and invoice will be sent six (6) weeks prior the arrival date, confirming the balance of payment due (‘Outstanding Balance’).

 

 

 

 

 

 

 

 

 

 

 

 

 

 

(b) Full payment of the Outstanding Balance must be made no later than four (4) weeks prior to the arrival date.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

(c) Once the Outstanding Balance has been received, the Landlord will send confirmation of the full booking, including arrival and departure dates and arrangements for the collection and return of the keys.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

5. Arrival and Departure Dates and Times

(a) The Property will be ready for occupation from on the arrival date and must be vacated by on the departure date.

 

 

 

 

 

 

 

(b) Guests wishing to arrive at an earlier time or leave at a later time should contact the Landlord to make special arrangements to vary these terms and conditions. Payment of an additional charge of fifty Pounds Sterling (£50.00) will be made to vary these terms and conditions.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

6. Cancellation

The Guest may cancel this booking at any time, subject to the following conditions:

 

 

 

 

 

 

 

 

 

 

 

 

 

 

(a) The Rental Deposit is forfeit if the booking is cancelled between the time of the booking and four (4) weeks prior to the arrival date.

(b) If cancellation is made between thirty-one (31) to forty-two (42) days prior to the arrival date, fifty per cent (50%) of the total rental cost of the Property for the Term will be forfeit.

 

 

 

 

 

 

 

(c) If cancellation is made between fifteen (15) to thirty (30) days prior to the arrival date, fifty per cent (50%) of the total rental cost of the Property for the Term will be forfeit.

 

 

 

 

 

 

 

(d) If cancellation is made later than fourteen (14) days prior to the arrival date or after the Guest has arrived, the total rental cost of the Property for the Term will be forfeit.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

7. Warranties, Obligations and Undertakings

The Guest hereby gives the following warranties, obligations and undertakings:

 

 

 

 

 

 

 

(a) that s/he is over eighteen (18) years of age;

 

 

 

 

 

 

 

(b) that no animals or pets will be permitted to occupy the Property during the Term; and

 

 

 

 

 

 

 

(c) that s/he is in receipt of appropriate insurance cover.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

8. Exclusion of Liability

It is hereby understood and agreed that:

 

 

 

 

 

 

 

(a) No liability will be accepted for any injury sustained by the Guest or their visitors whilst on the premises or any loss or damage to personal Property.

(b) No liability will be accepted for any loss or damage howsoever caused whilst staying in the Property.

 

 

 

 

 

 

 

9. Jurisdiction

These terms and conditions shall be subject to the laws of Barbados and the courts of Barbados shall be the court of jurisdiction.
